Le titre II, article 512 (a), du
DMCA prévoit que les fournisseurs de services sur l'internet (Internet
Service Providers) bénéficient d'une exemption de responsabilité
(limitation for transitory communications), dès lors qu'ils ne sont pas
à l'origine de la transmission des fichiers protégés, et qu'il en
organise le simple acheminement sans en modifier le contenu.
DIGITAL MILLENIUM COPYRIGHT ACT
- article 512(a) :
"In order
to qualify for this limitation, the service provider’s activities must
meet the following conditions:
- The transmission must be initiated by a person other than the
provider.
- The transmission, routing, provision of connections, or copying must
be carried out by an automatic technical process without selection of
material by the service provider.
- The service provider must not determine the recipients of the
material.
- Any intermediate copies must not ordinarily be accessible to anyone
other than anticipated recipients, and must not be retained for longer
than reasonably necessary.
- The material must be transmitted with no modification to its
content."

- § 107 - Limitations on exclusive rights : Fair use
"Notwithstanding
the provisions of sections 106 and 106A,the fair use of a copyrighted
work,including such use by reproduction in copies
or phonorecords or by any other means specified
by that section,for purposes such as criticism,comment,news
reporting,teaching (including multiple copies for classroom
use),scholarship,or research,is not an infringement of copyright.In
determining whether the use made of a work in any particular case
is a fair use the factors to be considered shall include —
(1) the purpose and character of the use,including whether such use is of
a commercial nature or is for nonprofit educational purposes;
(2) the nature of the copyrighted work;
(3) the amount and substantiality of the portion used in relation to the
copyrighted work as a whole;and
(4) the effect of the use upon the potential market for or value of the
copyrighted work.
The fact that a work is unpublished shall not itself bar a finding of
fair use if such finding is made upon
consideration of all the above factors."

under this title alleging infringement of copyright based on the

device, a digital audio recording medium, an analog recording device, or
an analog recording medium, or based on the noncommercial use by a
consumer of such a device or medium for making digital musical
recordings or analog musical recordings."
